Firstly, just a note to let you all know how busy it is and, to
reassure you, that this is a very good time to list your home for
sale. Buyers are still sharpening their pencils and o ering the odd
cheeky o er but, on a whole, things are moving and the prices
seem to be fair. We have had some really challenging times with
the Clearance Certi cates as they are only valid for 60 days. Then
we have delays with the Deeds O ce and the Certi cates expire! It
is really di cult to co-ordinate these things on a daily basis. The
Deeds O ce have also been very strict and if every document is
not 100% correct, they are thrown out, only to start the process
again. So, my advice to you is to make sure that you are on the Title
Deed as the registered seller, that your tax is up to date with SARS,
that you have informed your bank that you are selling timeously to
avoid penalty interest and, more common, your marital status is
absolutely correct for the relevant documents. Just be a
participant in the whole process to enable the paperwork to pass
through smoothly. Also, Power of Attorney dies upon death and if
a Trustee of a Trust passes away, you cannot sell as a remaining
Trustee without the Master of the High Court approval.
